Confirm dialog box modality

I have a confirm popup dialog box. It is not behaving modal-ly. Is this expected behaviour?
This javascript code is embedded inside some coldfusion code. A condition is checked, and if true, the confirm box is opened. The code is supposed to proceed only after user input – but that is not observed.

Depends upon how the confirm dialog box is generated. I can think of five ways to generate such a popup -- only two of which are modal. "coldfusion" tells me nothing other than I recognize it as a form of server-side code.
