Unexpected CSS changes with overlay

I’m building an interface and it’s working/looking fine but there is an option for the user to open a record (folder icon), when it is clicked a page overlay appears similar to lightbox but much simpler. What is happening in IE7 is the orange banner that goes across the top of the page loses it’s top-margin spacing on this action. Any ideas why?
